Practice areas

Four rights. One firm handling all of them.

Most businesses own more than one kind of intellectual property: a brand name, a product design, software code, a process. We advise on how each should be protected and handle the filing, prosecution and follow-through under one roof.

Term of protection in India

How long each right lasts.

Every right runs on its own clock. Knowing the term decides which protection to pursue first and when the next renewal falls due.

The registration process

What happens after you instruct us.

Each right follows a statutory route with fixed windows. We track every deadline and report to you at each stage, so nothing lapses on a missed date.

  1. Search & clearance

We search the register for identical and similar marks in your classes and give a written opinion on registrability.

  2. Filing

The application is filed on Form TM-A. You may use the ™ symbol from this point.

    Application number issued on filing
  3. Examination

The Registry examines the mark. If it raises objections, we draft the reply and represent you at any hearing.

  4. Advertisement

Once accepted, the mark is published in the Trade Marks Journal for public notice.

  5. Opposition window

Third parties may oppose the mark. We defend any opposition filed against you.

    4 months from publication
  6. Registration

The registration certificate issues and you may use the ® symbol. We diarise the renewal date.

    Valid for 10 years

Which of the 45 classes covers your business?

India follows the Nice Classification. Classes 1 to 34 cover goods and 35 to 45 cover services. Search by what you sell to see where your mark should be filed.

Unsure? Most businesses need two or three classes. Ask us for a class recommendation before you file.

Common questions

Before you file.

Short answers to what clients ask most. For advice on your specific case, speak with us.

How long does trademark registration take in India?

Where the mark faces no objection or opposition, registration commonly completes within 12 to 24 months of filing. Objections, hearings or an opposition extend that. Your application date still counts as the effective date of registration.

When can I use ™ and when can I use ®?

You may use ™ once you have adopted a mark or filed for it. The ® symbol may be used only after the mark is registered. Falsely representing a mark as registered is an offence under section 107 of the Trade Marks Act.

Copyright is automatic. Why register it?

Copyright exists from the moment an original work is created. Registration puts the particulars on the public record, and the register entry is prima facie evidence in court, which makes it far easier to prove ownership in an infringement dispute.

Should I file a provisional patent application?

A provisional application is useful when the invention is still being developed. It secures an early priority date at lower cost, and you then have 12 months to file the complete specification with full claims.

Are there reduced official fees for startups and small businesses?

Yes. Individuals, recognised startups and registered MSMEs pay reduced official fees for trademark and patent filings in India. We confirm your eligibility and file the supporting documents.

Can you protect my brand or invention outside India?

Yes. We file international trademark applications through the Madrid Protocol and international patent applications through the PCT, and coordinate national filings with associate firms in other countries.
